Privacy Policy

At ACT, we respect your concerns about privacy. This Policy is intended to inform you of the steps we take to protect the Personal Information (as defined below) that you choose to provide to us. We also describe the measures we take to protect the security of the information and how you can contact us about our privacy practices.

This policy (together with our Terms and Conditions of Use and any other documents referred to in it) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. The Policy applies to the website, the member intranet, and to all the services offered by ACT.

In the context of the General Data Protection Regulation (“the GDPR”), the data controller is ACT EEIG, a European Economic Interest Grouping registered in Belgium (Register of Legal Entities (Brussels): 0438.023.393) whose registered office is at 26 Rue des Deux Eglises, Brussels 1000, Belgium. As data controller, ACT is responsible for deciding how it holds and uses personal information about you.

Please be aware that we are not responsible for the privacy practices of other web sites even if we try to link only to sites that share our respect for privacy. For this reason, please review the privacy policies of these web sites before disclosing any personal information to or through them.

By using this website, intranet and all services offered by ACT you fully and unconditionally accept the present Terms of Use and undertake to comply with them. If you do not agree with these Terms of Use, you should refrain from making any use whatsoever of the ACT Website, intranet and all services offered by ACT.

Data we collect

As an ACT Member and ACT Intranet user, we collect personal information such as, but not limited to:

  • your e-mail address
  • first name
  • last name
  • postal code
  • address
  • professional, mobile and / or home telephone number
  • fax number
  • identification number
  • location data
  • online identifier/login credentials

that we directly or indirectly collect or otherwise receive from you, whether manually or digitally processed (the “Personal Information”).

Also, through the use of our websites, social media, e-mail response, cookies, clicking data, navigation data and other technologies, we can collect data about you. For suppliers or other companies we work with, we also keep, other than the data mentioned above, company data such as VAT number or enterprise number, the coordinates of contact persons of the legal entity (name, function, telephone …) as well as of the associates, partners in the business. Afterwards they have the opportunity to check, correct, change their data or decide not to let them be used anymore.

We may collect and process the following information about you:

  • information when you report a problem with our site;
  • if you contact us, we may keep a record of that correspondence;
  • details of your visits to our site including, but not limited to, traffic data, location data, weblogs and other communication data.

Legal basis for processing personal member data

Where personal data is processed by ACT for the proper performance of services, the legal basis for doing so is legitimate interest. That is to say that the processing is necessary for ACT’s legitimate interest to deliver services that may require personal data being processed and shared.

How we use the information we obtain

We may use the information described above to:

  • send you newsletters and other communications
  • communicate with you about, and administer your participation in events
  • respond to your enquiries
  • perform data analyses
  • operate, evaluate and improve our services (including enhancing, improving and analysing our services; managing our communications; and performing accounting, auditing and other internal functions);
  • protect against, identify and prevent fraud, copyright infringement, unauthorised use and distribution of protected content and other criminal activity; and
  • comply with and enforce applicable legal requirements, relevant industry standards and our policies, including our Terms of Use.

Information we share

We do not disclose personal information we obtain about you, except as described in this Privacy Policy. We may share personal information with service providers who perform services on our behalf based on our instructions. We do not authorise these service providers to use or disclose the information except as necessary to perform services on our behalf or comply with legal requirements. Examples of these service providers include entities that provide web hosting and analytics.

We also may disclose information about you (i) if we are required to do so by law or legal process, (ii) to law enforcement authorities or other government entities based on a lawful disclosure request, or (iii) when we believe disclosure is necessary or appropriate to prevent harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity.

Information collected through third-party plug-ins and widgets on the Sites (such as information relating to your use of a social media sharing tool) is collected directly by the providers of the plug-ins and widgets. This information is subject to the privacy policies of the providers of the plug-ins and widgets, and the ACT is not responsible for those providers’ information practices.

How long will the information be kept?

We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.
To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances we may anonymise your personal information so that it can no longer be associated with you, in which case we may use such information without further notice to you.
Once we are notified you are no longer a representative of an ACT member company, we will retain and securely destroy your personal information in accordance with applicable laws and regulations.

IP Addresses and Cookies

We may collect information about your computer, including where available your IP address, operating system and browser type, for system administration and to report aggregate traffic. This is statistical data about our users' browsing actions and patterns, and does not identify any individual.

For the same reason, we may obtain information about your general internet usage by using a cookie file which is stored on the hard drive of your computer. Cookies contain information that is transferred to your computer's hard drive. They help us to improve our site and to deliver a better and more personalised service. They enable us:

  • to estimate our audience size and usage pattern;
  • to store information about your preferences, and so allow us to customise our site according to your individual interests;
  • to speed up your searches; and
  • to recognise you when you return to our site.

Security

Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your information transmitted to us. Please remember that other methods of Internet communication, such as emails and messages sent via a website, are not secure unless they are encrypted. Any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need to know. They may only process your personal information on our instructions and they are subject to a duty of confidentiality. We have put in place procedures to deal with any suspected data security breach and will notify you and any applicable regulator of a suspected breach where we are legally required to do so.

Some of those employees, contractors and affiliated organisations may be located outside of your home country; by using ACT’s websites, you consent to the transfer of such information to them.

Access to personal information

  • the right to ask what personal data we hold about you at any time
  • the right to ask us to update and correct any out-of-date or incorrect personal data that we hold about you
  • the right to ask us to delete personal data that we hold about you
  • the right to opt out of any communications that we may send you.

Updates to our privacy policy

Our Privacy Policy may change from time to time.  This policy will be updated if there are any changes in our practice.  The amended version will be published on the Site and will replace any previous privacy policy wording and all conditions and terms of use will be in force from the date of publication.
